2022-2023 Sustainable Hygiene Heroes Contest Official Rules
THERE IS NO PURCHASE NECESSARY TO ENTER OR WIN. MAKING A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
CONTEST PERIOD: The Sofidel Sustainable Hygiene Heroes contest (“Contest”) begins on October 11, 2022 at 12:00 a.m. Eastern Time and ends on or about February 20, 2023 at 11:00 a.m. Eastern time (the “Contest Period”). Sofidel America, Corp.’s (“Sofidel” or “Sponsor”) timekeeping device will be the official timekeeping device for the Contest.
ELIGIBILITY: Contest Nominees must be legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age (or the age of majority in their state of residence if greater than eighteen (18) or older as of the date of entry and are custodians, facility managers, small business owners or other individuals who are responsible for maintaining clean, safe and sustainable facilities (each a “Nominee”). Employees, representatives, agents of Sofidel and its subsidiaries, affiliates, advertising agencies and public relations agencies and members of their immediate family (i.e., spouse, mother, father, parents-in-laws, grandmother, grandfather, brother, sister, children and grandchildren) and persons domiciled with them, whether or not related, are not eligible for consideration as a Nominee in this Contest. VOID WHERE PROHIBITED OR RESTRICTED BY LAW.
NOMINATION PROCESS: Individuals may nominate a Nominee (a “Nominator”) from October 11, 2022 – February 10, 2023 by: (1) visiting the website www.sustainablehygieneheroes.com (the “Website”) and following the instructions to complete the entry form by providing the Nominator’s full name, email address, and phone number, and the Nominee’s full name, business or employer’s name, address of residence, the Nominee’s city, the Nominee’s state, and the Nominee’s zip code, phone number, and date of birth (the “Entry Form”); and (2) writing, in 500 words or less, why the Nominee should be selected as a sustainable hygiene hero (a “Submission”). Nominator may not nominate themselves or be eligible to receive a prize in this Contest.
Proof of submitting an entry does not constitute proof of receipt by Sponsor. All entries become the property of Sponsor and will not be returned to the Nominator or acknowledged. Entries submitted by script, macro or other automated or mechanical means, entries by any means which subvert the entry process, entries mechanically reproduced, and entries made in any fashion other than as specified herein are void and will be disqualified. Entry must be made by the Nominator. Final eligibility for the award of a prize is subject to eligibility verification as set forth below.
In the event of a dispute, entries will be declared made by the authorized account holder of the email address submitted at time of entry. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.
By participating in this Contest, whether or not a Nominator’s Nominee becomes a Finalist, Nominator unconditionally agrees to these Official Rules and Sofidel’s Privacy Policy www.papernet.com/americas/en/privacy, which is incorporated herein by reference. Failure to comply with the Official Rules or the Privacy Policy (as determined within the sole discretion of Sofidel) may result in disqualification.
SUBMISSION GUIDELINES: Submissions must be the original work of the Nominator. Submissions also must not have been previously published, not have won previous awards, not contain plagiarized content, not be offensive, inappropriate, obscene, indecent, or contain hate speech, contain anything that is illegal, as determined by Sponsor or the judges in their sole discretion, and not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Sponsor reserves the right to disqualify any Submission by a Nominator that it determines, in its sole discretion, is offensive, inappropriate, obscene or indecent, and contains hate speech, plagiarized content or anything that is illegal, does not keep with Sponsor’s image or that is otherwise not in compliance with these Official Rules.
Nominator further represents and warrants to Sofidel that (a) Nominator has obtained the express approval and permission from any person who may appear or be mentioned in any way in your Submission, including the Nominee, and (b) Sofidel’s use of Nominator’s Submission will not result in the infringement of any copyright, trademark, right of publicity, privacy or other legal right of any third party.
PRIZES: One (1) grand prize winner will receive four thousand dollars ($4,000), and the grand prize winner’s facility will receive $500 in paper products from Sofidel. If the grand prize winner is nominated by their facility’s sales representative, the sales representative will receive two thousand dollars ($2,000). The total approximate retail value (“ARV”) of the grand prize is six thousand five hundred dollars ($6,500). Two runners-up will each receive five hundred dollars ($500). The total ARV of the runner-up prizes is one thousand ($1,000) dollars. The total approximate retail value of the prizes is seven thousand five hundred dollars ($7,500).
Prizes are awarded “AS IS” with no offer of any warranty or guarantee, either express or implied (including, without limitation, quality, merchantability and fitness for a particular purpose) made by Sofidel. Prize details and availability are subject to change, in which case a prize of equal or greater value may be substituted at Sofidel’s sole discretion. Prizes consist only of the items listed, are non-transferable, with no cash redemption or substitution except at Sofidel’s sole discretion. The prize winners are solely responsible for all applicable federal, state or local taxes in connection with their receipt and/or use of the prizes. Winners are also solely responsible for all costs, fees or expenses not included as part of a prize. The grand prize winner will be required to provide his/her Social Security number for tax reporting purposes. Sponsor will not replace a lost, damaged or stolen prize.
JUDGING AND FINALIST SELECTION: At the end of the Entry Period, a panel of judges consisting of employees/representatives of Sofidel (the “Panel”) will evaluate all eligible Submissions (the “Judging Period”) using the following criteria, as weighted in the Panel’s sole discretion: (i) the compellingness of the nomination(s) and (ii) the Nominee’s quality of service, commitment to sustainability and dedication (the “Judging Criteria”). Odds of winning will depend on the total number of eligible entries received. All decisions of the Panel are final. The Nominees identified in the five (5) Submissions receiving the highest scores from the Panel shall be deemed the potential finalists. In the event of a tie, an additional independent judge will determine the potential finalists based on the Judging Criteria.
FINALIST AND WINNER NOTIFICATION: Sofidel will contact each potential finalist by the telephone number, mailing address or email address provided on the Entry Form to verify that the potential finalist complies with these Official Rules and consents to participate in the Contest on or about 14 days after the end of the Judging Period (the “Notification”). Each potential finalist must provide Sofidel with its consent to participate in the Contest, including its acceptance of and agreement to these Official Rules, by responding by mail within ten (10) days of the date on the Notification and providing all information requested by Sofidel, which may include signing and returning an affidavit of eligibility and release of liability and, except where prohibited by law, a publicity release (an “Affidavit”).
Sofidel is not responsible for any delay or failure to receive notification for any reason, including inactive email account(s), technical difficulties associated therewith, or potential finalist’s failure to adequately monitor any email account. If a potential finalist cannot be contacted, is disqualified, fails to timely execute and return any required forms or fails to otherwise comply with these Official Rules, he/she may be subject to disqualification and prize forfeiture, and Sponsor reserves the right, in its sole discretion, to designate the Nominee identified in the Submission with the next (and so forth) highest score as an alternate potential finalist. Under no circumstances will more than the advertised number of prizes be awarded.
Upon Sofidel’s verification of a potential finalist’s eligibility, the potential finalist shall be deemed a “Finalist.” The Finalist identified in the Submission that received the highest score shall be deemed the grand prize winner, and the two Finalists with the next two (2) highest scores shall be deemed the runner-up prize winners. Any winner’s rejection of a prize or return of a prize may result in disqualification and prize forfeiture.
PUBLICITY & MARKETING: EXCEPT WHERE PROHIBITED BY LAW, BY ENTERING THE CONTEST, NOMINATORS AND NOMINEES AGREE THAT SOFIDEL AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, SUPPLIERS, DISTRIBUTORS, ADVERTISING/PROMOTION AGENCIES, AND EACH SUCH COMPANY’S OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, REPRESENTATIVES, AND SUCCESSORS AND ASSIGNS (COLLECTIVELY, THE “RELEASED PARTIES”) HAVE THE ABSOLUTE RIGHT AND PERMISSION TO PUBLISH NOMINATOR’S SUBMISSION ON THE WEBSITE AND TO BROADCAST, PUBLISH, OR OTHERWISE USE (IN ANY OTHER CHANNEL OR MEDIUM) NOMINATOR’S SUBMISSION, NOMINATOR AND NOMINEE’S BUSINESS NAME, BIOGRAPHICAL AND OTHER INFORMATION PROVIDED AS PART OF NOMINATOR’S ENTRY FOR ANY COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSE WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO NOMINATOR OR NOMINEE. BY ENTERING, NOMINATOR GRANTS THE RELEASED PARTIES AN EXCLUSIVE, ROYALTY-FREE AND IRREVOCABLE LICENSE AND RIGHT (BUT NOT THE OBLIGATION) TO TELECAST, BROADCAST, COPY, EDIT, ADAPT, MODIFY, REPRODUCE, PUBLISH, CREATE DERIVATIVE WORKS OF, DISTRIBUTE, USE, OR OTHERWISE PUBLICLY DISPLAY ANY OR ALL OF NOMINATOR’S SUBMISSION, OR ANY PORTION THEREOF (INCLUDING ANY OTHER CONTENT SUBMITTED OR PROVIDED TO SPONSOR), IN ANY MANNER OR MEDIUM THROUGHOUT THE WORLD IN PERPETUITY, FOR COMMERCIAL, PUBLICITY, OR PROMOTIONAL PURPOSES, AND TO LICENSE OTHERS TO DO SO, WITHOUT LIMITATION, REVIEW OR APPROVAL, OR COMPENSATION TO NOMINATOR.
PRIVACY: Entrant information received shall be treated by Sponsor in accordance with Sponsor’s privacy policy, which is located at https://www.papernet.com/americas/en/privacy.
NO LIABILITY & INDEMNIFICATION: Sofidel is not responsible for and entrants release Sofidel from any failures of any kind (whether caused by computer, technical, or human error) which may either limit the entrant’s ability to submit an entry, claim a prize, or otherwise participate in this Contest, or Sponsor’s ability to include all eligible entries, notify potential winners, or otherwise execute this Contest in the manner intended. Sponsor also assumes no responsibility or liability for (a) any late, lost, damaged or incorrect entries; (b) any typographical errors in the offer or administration of the Contest, including, but not limited to, errors in any Contest-related materials, including all advertising for the Contest, these Official Rules and the distribution of the prizes; (c) incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (d) any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Contest; (e) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, camera, computers or providers utilized in any aspect of the operation of the Contest; (f) inaccessibility or unavailability of any network or wireless service, the Internet or website or any combination thereof; (g) suspended or discontinued Internet, wireless or landline phone service; or (h) any injury or damage to participant’s or to any other person’s computer or mobile device which may be related to or resulting from any attempt to participate in the Promotion or download of any materials in the Contest.
Nominators and Nominees further release and agree to defend, indemnify and hold harmless the Released Parties from any and all liability, claims or actions of any kind whatsoever arising from injuries, damages, or losses to persons or property (including, without limitation, real property and personal property) which may be sustained in connection with this Contest including, but not limited to: (a) their participation in this Contest; (b) the receipt, ownership or use or misuse of any prize awarded; and (c) their breach of any of the terms in these Official Rules. Each Nominator and Nominee further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of participating in the Promotion, and in no event shall the Released Parties be liable for attorney’s fees. Nominators and Nominees waive the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages (other than for actual out-of-pocket expenses) and any and all rights to have damages multiplied or otherwise increased.
OTHER TERMS: Decisions of Sponsor and/or the Panel on all matters related to the Contest are final. Sponsor reserves the right to cancel or modify the Contest for any reason, including but not limited to, if fraud, misconduct or technical failures destroy the integrity of the Contest, or if a computer virus, bug, or other technical problem corrupts the administration, security, or proper administration of the Contest as determined by Sofidel, in its sole discretion, Sofidel reserves the right to disqualify or prohibit the participation of an individual if fraud or tampering is suspected, or if the individual fails to comply with any requirement of participation or with any provision in these Official Rules.
CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE OPERATION OF THIS CONTEST IS A VIOLATION OF CRIMINAL & CIVIL LAWS. SOFIDEL RESERVES THE RIGHT TO DISQUALIFY AND/OR SEEK DAMAGES FROM ANY INDIVIDUAL MAKING ANY SUCH ATTEMPTS TO THE FULL EXTENT PERMITTED BY LAW.
RIGHT TO DISQUALIFY: Sponsor reserves the right to disqualify or prohibit your participation in this Contest if fraud or tampering is suspected; if you fail to comply with any requirement of participation or with any provision in these Official Rules; if the nature of your business and/or your behavior or communication at any point is disruptive, may or does cause damage to any person, property, or to the reputation of Sofidel, or is otherwise not in accordance with all applicable laws and generally accepted social practices, all as determined in Sofidel’s sole discretion.
GOVERNING LAW: The Contest is governed by the laws of the Commonwealth of Pennsylvania without regard to conflicts of law principles. Entrants consent to the jurisdiction and venue of the federal or state courts located in the Commonwealth of Pennsylvania for the resolution of any disputes, claims and causes of action arising out of or relating to this Contest or any prize (individually, “Claim”). All Claims shall be resolved individually, without resort to any form of class action. Any claims, judgments and/or awards shall be limited to actual out-of-pocket costs incurred, including without limitation costs incurred with entering this Contest. Nominators and Nominees hereby waive any rights or claims to attorney’s fees, indirect, special, punitive, incidental or consequential damages of Nominator or Nominee, identifiable persons, or third party participants, whether foreseeable or not and whether based on negligence or otherwise.
